General Terms & Conditions (GTC)

Note on Gender Terminology: For improved readability, the masculine form is used throughout these General Terms and Conditions. All gender identities are equally intended.

Legal Disclaimer: This English version of the General Terms and Conditions is a non-binding translation provided for convenience. Only the original German version is legally binding and shall govern in case of any inconsistency, interpretation, or dispute.


1. Scope of Application

These General Terms and Conditions govern the contractual relationship between Swisstrin AG (henceforth: “Swisstrin”) and its clients in connection with cosmetic, non-invasive trichological treatments and the purchase and use of related self-treatment products. Any conflicting terms from clients are not accepted unless explicitly agreed upon in writing by Swisstrin.


2. Contracting Parties

Swisstrin, headquartered at Zürichstrasse 5, 6004 Luzern, Switzerland, is the provider. The client is the natural person using the offered services or products.


3. Subject Matter of the Contract

The contract covers cosmetic, non-medical, and non-invasive treatments by qualified Swisstrin personnel, along with the sale of home-use products. Treatments are individually tailored and may occur at Swisstrin’s clinic, at home, or both.


4. Contract Conclusion

A contract is established when Swisstrin issues a tailored offer following a needs assessment, and the client accepts it by signing physically or electronically, or via explicit email confirmation. These GTC are binding upon contract acceptance.


5. Payment

Payment obligations begin upon contract conclusion. Accepted payment methods include credit/debit cards on-site, invoicing (14-day terms), and agreed installment plans. In case of default, Swisstrin may cancel the contract and charge a flat CHF 200 administrative fee. Previously delivered services and products will be invoiced.


6. Appointments

Appointments for assessments can be rescheduled or canceled free of charge up to 4 hours in advance. No-shows without timely notice will incur a CHF 100 fee.

Late arrivals may shorten treatment sessions. Missed treatment or check-up sessions without 4 hours’ notice are forfeited.

Swisstrin may reschedule for valid reasons and will offer a replacement session free of charge.

If no contract follows the first analysis, Swisstrin offers a second, shorter session free of charge. All further pre-contract assessments sessions are charged at CHF 250 each.


7. Cancellation or Termination

Clients may cancel treatment with 30 days’ notice. Payment is due for services and products received through the end of the notice period.

Valuation of services: The total amount due for all services except on-premises treatments (which are charged at CHF 90 per treatment session provided) is allocated across the individual 6-month treatment cycles as follows, with the first cycle beginning on the day the contract is concluded:

For 800-day treatment plans:

  • Laser Cap: CHF 400
  • For days 1–200: CHF 400
  • For days 201–400: CHF 600
  • For days 401–600: CHF 300
  • For days 601–800: CHF 300 minus any rebates granted.
 

The allocation of more than 50% of the total amount due to the first 400 days reflects the greater initial costs for laboratory work and check-ups. The allocation of CHF 600 to the final 400 days is equal to the amount charged for a continuous treatment after the initial 800-day plan.

For treatment plans shorter than 800 days, the percentages for each 200-day cycle are equal (100% divided by number of cycles), with the Las Cap charged separately at CHF 400.

An 11% surcharge on all costs will be charged for clients on monthly payment plans.

The services for each 200-day cycle are considered fully rendered as of the first day of the cycle, with the exception of any treatments conducted on the premises of Swisstrin AG, which are charged at CHF 90 per treatment session provided. Products shipped by Swisstrin are considered rendered services.

Swisstrin may terminate treatment (e.g., due to payment default or repeated absences) under the same refund and billing terms.

Advance payments are refunded for undelivered products and services.

If the client has not yet paid in full at the time of cancellation, the outstanding balance is due immediately. Installment plans are canceled only after full payment of the remaining balance.


8. Product Delivery

Home-care products may be picked up or shipped. Shipping costs are covered by Swisstrin. Delays will be communicated by email. If a delay exceeds 30 days, the client may cancel the affected product order. The rest of the contract remains in force.


9. Inspection Obligation

Clients must inspect received goods immediately for completeness, accuracy, and condition. Defects must be reported in writing within 14 days with documentation. For hidden defects, the deadline begins upon discovery. Unreported defects imply acceptance.


10. Warranty

If defects are reported on time, Swisstrin will replace or reship the product. No further warranties apply. Statutory warranty rights (Art. 197 ff. CO) are excluded as permitted by law. The client bears the burden of proof.


11. Guarantee

Swisstrin provides no guarantee of specific treatment outcomes. Results vary individually. Manufacturer instructions and Swisstrin guidelines must be followed. Any manufacturer warranties are passed to the client.


12. Liability

Swisstrin disclaims liability for slight negligence to the extent permitted by law. No liability applies for improper use or personal intolerance. This includes all legal bases, including tort (Art. 41 ff. and Art. 62 ff. CO), errors in consent (Art. 23 ff. CO), or others.


13. Website Content

Website content is for informational purposes only. Swisstrin accepts no liability for accuracy, completeness, or timeliness, especially regarding displayed treatment results.


14. Data Protection

Personal data is processed in accordance with the Privacy Policy published on the website, which forms an integral part of these GTC.


15. Severability Clause

If any provision of these GTC proves invalid or unenforceable, the remaining provisions remain valid. The invalid clause shall be replaced with an equivalent, enforceable provision.


16. Amendments

Swisstrin may update these GTC at any time for valid reasons (e.g., legal changes, service expansions). Material changes will be communicated at least 14 days in advance by email.

If no written objection is received within 14 days, the updated GTC are deemed accepted. In case of objection, Swisstrin reserves the right to terminate the contract in a fair manner.

18. Governing Law

All contractual relationships with Swisstrin are governed exclusively by Swiss law.


19. Jurisdiction

The exclusive place of jurisdiction for all disputes is the competent court at the registered office of Swisstrin AG in Lucerne, Switzerland.
